– Any materials that could pose health, safety or security risks

2. HOW OUR SERVICE WORKS

2.1 The Process
a) Request a free Gold Pack via our website
b) Send your items using our pre-paid Royal Mail Guaranteed Delivery service
c) We test and value your items upon receipt
d) For instant payment customers: immediate payment processed
e) For contact customers: we provide valuation and await your decision
f) Payment sent or items returned based on your choice

2.2 Nature of Transaction
For instant payment customers: By selecting instant payment and posting items, you make an irrevocable offer to sell at our valuation. This cannot be withdrawn once posted.

For contact customers: By posting items, you are requesting a professional valuation. You may accept or reject our offer, subject to Section 9.

If we’ve provided a quote before posting (rare): That quote may be binding subject to our verification of items upon receipt.

The contract is formed when:
– We process instant payment (instant payment customers), OR
– You accept our valuation (contact customers), OR
– 14 days pass without payment of rejection fees (automatic acceptance)
The finality of any contract formed under this clause is in all cases subject to Section 5.7 (Authenticity, Title, and Post-Payment Adjustments), which governs items that are not genuine, not as described, or not lawfully the customer’s to sell.

2.3 No Advance Valuations
We do not provide valuations without physically testing your items. Any estimates given are for guidance only and are not binding. Actual valuations are based solely on our professional testing upon receipt.

3. POSTING AND INSURANCE

3.1 Free Gold Pack Service
– We provide free Gold Packs including pre-paid Royal Mail Guaranteed Delivery
– Standard insurance coverage is £750

– We will include the additional insurance cost in your valuation if you sell to us
– If you reject our offer, you must pay this additional insurance cost yourself

We provide a protective bubble wrap envelope with every Gold Selling Pack for the safe transit of your items. Where customers choose to include additional packaging of their own — such as boxes or outer wrapping — we will always handle these with care. However, due to the nature of our storage and processing facilities, we cannot guarantee that additional customer packaging will be retained or returned in the event of a rejected valuation. We recommend removing any packaging you wish to keep before posting your items to us.

4. INSTANT PAYMENT OPTION

4.1 Choosing Instant Payment
By selecting “pay me instantly without contacting me” you agree to:
– Irrevocable acceptance of our valuation
– Waiving all rights to reject or dispute the valuation
– No price matching available
– Payment is final and binding immediately upon processing
– Items are immediately sent for melting/refining

– Payment processed within average 20 minutes (not guaranteed)
– Payment sent to details provided in your Gold Pack
– Valuation breakdown available upon request for transparency
– No negotiation or amendment possible after payment

4.3 Binding Nature
Instant payment is irreversible. Once processed, you cannot:
– Dispute the valuation
– Request items back
– Claim price matching
– Reverse the transaction

The irreversibility in this clause applies to genuine transactions only and is subject to Section 5.7. It does not prevent us from reversing a transaction, or recovering payment, in respect of an item that is subsequently established to be counterfeit, misrepresented, not as described, or not lawfully yours to sell.

5. VALUATION AND TESTING

5.1 Testing Procedures
By sending items, you explicitly consent to:
– Destructive and non-destructive testing
– Acid testing that may cause permanent marks
– Filing and scratching for purity testing
– Dismantling of items
– Removal and potential damage to stones
– XRF analysis
– Any other testing we deem necessary
This consent extends to any further testing we carry out after a valuation has been accepted or after payment has been made, as set out in Section 5.7.

5.2 Valuation Standards
– Items valued based on precious metal content only
– Craftsmanship, brand, or resale value not considered
– Gemstones generally valued at £0 unless exceptional
– We use London Bullion Market Association rates
– Valuations valid until 6pm same day only

5.3 Weight Tolerance
– We work to 2g weight tolerance
– Minor variations within tolerance processed at actual weight
– Significant variations trigger consultation process

5.4 Contact Customers
If you choose to be contacted with your valuation:
– We’ll call or email with our offer
– You can accept or reject our valuation
– You can accept through our portal at track.goldsell.co.uk
– Acceptance is binding and items immediately processed
– You are under no obligation to accept; qualifying parcels are returned free of charge (see Section 9)

Formation of Contract by Payment: Where you have specified in writing a price at which you would accept the valuation, GoldSell’s processing of payment at that price constitutes our acceptance of your offer to sell. Upon payment processing, the contract is binding and final. No refund, reversal, or return is available after payment has been processed, save as provided in Section 5.7 in respect of items that are counterfeit, misrepresented, not as described, or not lawfully yours to sell.

5.5 ERROR CORRECTION AND OVERPAYMENTS

a) Error Identification:
– Despite careful procedures, human error may occur
– We reserve the right to correct any valuation errors
– Corrections may be identified through audit, review, quality checks, or accounting processes

b) Overpayment Recovery:
– We have 30 days from payment date to identify overpayments
– You will be notified immediately of any overpayment
– You agree to return overpaid amounts within 30 days of notification
– We may provide evidence including third-party valuation if disputed

c) Legal Remedies:
– Failure to return overpayments constitutes breach of contract
– We reserve all legal rights including:
– Debt recovery proceedings
– Interest at 8% above Bank of England base rate
– All legal and administrative costs
– Credit reference agency notification
– Criminal prosecution for fraud if applicable

d) Underpayments:
– If we identify underpayment, we’ll pay the difference immediately
– This demonstrates our commitment to fairness and accuracy

5.6 Minimum Quantities
– Gold: we require a minimum of 5g of gold content within a Gold Selling Pack in order to provide a valuation and complete a purchase.
– Silver: we require a minimum of 100g of silver content within a Gold Selling Pack in order to complete a purchase.
– Mixed packs: where a pack contains both gold and silver, meeting the minimum for either metal removes the minimum for the other. A pack containing at least 5g of gold qualifies in full, and we will purchase any quantity of silver sent with it. A pack containing at least 100g of silver qualifies in full, and we will purchase any quantity of gold sent with it, including where that gold content is below 5g.
– Below both minimums: where a pack contains less than 5g of gold and less than 100g of silver, we are unable to provide a valuation or make a purchase. The pack will be subject to our handling fee and the cost of Royal Mail return postage, invoiced in accordance with Section 9.

5.7 AUTHENTICITY, TITLE, AND POST-PAYMENT ADJUSTMENTS

5.7.1 Post-Receipt and Post-Payment Verification
– Notwithstanding any valuation or testing carried out upon receipt, we reserve the right to conduct further testing and verification on any item at any time, including after a valuation has been accepted and after payment has been processed.
– Such testing may be destructive and may include filing, drilling, sectioning, acid testing, specific gravity analysis, or any other method we deem necessary to establish an item’s true composition, purity, or authenticity.
– You acknowledge that surface and non-destructive methods, including XRF analysis, read only the outer layers of an item and cannot detect all deficiencies or sophisticated counterfeits, and that an item passing initial testing is not a warranty of its authenticity, purity, or title.

5.7.2 Customer Warranties
By signing our Declaration of Ownership and by sending items to us, you warrant that each item:
– is genuine, is what it purports to be, and is composed throughout of the precious metal and to the purity it presents as, including any hallmark, stamp, or marking it bears;
– is your lawful property, free from any lien, charge, or third-party claim, and is not the proceeds of, nor connected to, any unlawful activity;
– has not been altered, coated, filled, plated, or otherwise treated so as to misrepresent its true metal content or value.
These warranties apply to gold, silver and platinum in any form, including bullion, coins, bars, jewellery, and scrap.

5.7.3 Counterfeit and Misrepresented Items
– An item is counterfeit or misrepresented for the purposes of these terms where testing establishes that it is not, in whole or in part, the genuine item or the metal or purity it purports to be. This includes, without limitation: fabricated or imitation items; items plated, filled, clad, or cored with a different metal; and genuine items of a lower purity than their hallmark, stamp, or description indicates.
– Where the deficiency affects the whole item such that it is not the precious metal it purports to be, any purchase of that item is void from the outset, as no genuine item capable of forming the basis of a valid sale ever existed.
– Where the deficiency is partial — for example a genuine item of lower purity than represented — we reserve the right, at our discretion, either to void the purchase or to adjust the valuation and any payment to reflect the item’s true composition, recovering any resulting overpayment under clause 5.7.5.

5.7.4 Defective Title, Stolen Goods, and Unlawful Items
– Where, after purchase, an item is identified as stolen, subject to a third-party ownership claim, or connected to unlawful activity, or where we are required to act by law enforcement or under our anti-money-laundering obligations, we reserve the right to suspend or reverse the transaction and to withhold or surrender the item as required.
– Any payment made for such an item was made in reliance on your warranties at clause 5.7.2 and is recoverable from you in full under clause 5.7.5.
– We may withhold payment, retain items, and decline to complete any transaction pending the outcome of any enquiry, report, or request by a competent authority, and we accept no liability for delay arising from doing so.

5.7.5 Reversal and Recovery of Payment
– Where a deficiency under this Section 5.7 is identified before payment has been sent, we will not complete the affected purchase, and the transaction in respect of that item is at an end.
– Where payment has already been sent, the sum paid was made in reliance on your warranties and is recoverable by us in full as a debt immediately due and owing, whether the payment was made by bank transfer, cheque, cash, or any other method.
– You agree to repay any such sum within 14 days of our notification. We will provide evidence of our findings, which may include photographs, test readings, and, where relevant, third-party verification.
– Recovery follows the remedies set out at clause 5.5(c), including debt recovery proceedings, interest at 8% above the Bank of England base rate, all legal and administrative costs, credit reference agency notification, and referral to the appropriate authorities.
– Our payment methods are not reversible at your instigation; settlement of any dispute is governed by these terms.

5.7.6 Retention of Counterfeit and Unlawful Items
– Counterfeit, misrepresented, stolen, or unlawful items will be retained by us and will not be returned to you, save at our sole discretion or where required by law or by a competent authority.
– We will not return any item where, in our reasonable view, doing so may facilitate its further use, sale, or circulation, or conflict with any ongoing enquiry.
– Where a partial-deficiency item is not voided but adjusted under clause 5.7.3, ordinary return provisions apply only if you decline the adjusted valuation and settle any sums due.

5.7.7 Reporting
– We reserve the right to report any counterfeit, misrepresented, stolen, or suspicious item, and the associated transaction and customer information, to Action Fraud, the police, trading standards, HM Revenue & Customs, or any other competent authority, and to share relevant information with them for that purpose.
– Nothing in these terms obliges us to notify you before making such a report, nor to return any item where doing so would conflict with this right or any ongoing enquiry.

5.8 Dental Gold Handling and Refining
Dental gold is often received with tooth material, porcelain, ceramic or non-precious substructure still attached. An accurate valuation can only be provided once the precious metal has been isolated, as attached material affects the weight and composition our testing can read. As this material is also biological in nature, isolating the metal additionally removes the need for it to be handled directly. For these reasons, where dental gold is received in this condition, the material is cleaned as far as possible and then melted and refined in-house to recover and accurately value the precious metal content. This is carried out before a valuation is issued and permanently alters the item, so it cannot be returned in its original form, although the recovered metal can be returned should you not wish to proceed. By signing the valuation form declaration returned with your items, you consent to this process.

– This applies only to dental gold received with tooth material, organic residue or non-precious substructure attached. Dental gold that is already clean and fit for testing — for example, a cleaned gold cap — is not melted; it is tested, weighed and valued in the normal way.
– GoldSell holds all permits and approvals required to handle and refine this material.
– Your valuation is based on the recovered precious-metal content once isolated. Non-precious dental material carries no value, and this process does not reduce the precious-metal value payable to you.
– Should you not wish to proceed, the recovered metal can be returned to you. It cannot be returned in its original form, as melting is irreversible.
– A breakdown of what your material was found to contain can be provided for your records, even where it holds no gold content.
– This handling is destructive and is consented to under the valuation form declaration returned with your items, in the same manner as the testing consented to under clause 5.1.

6. GEMSTONES

6.1 Gemstone Valuation
– Gemstones generally have no value to us
– Removal costs often exceed gemstone value
– Remove valuable stones before sending items
– Exceptional gemstones may be valued at our discretion

6.2 Gemstone Handling and Return
Where gemstones or diamonds of considerable size, quality, or value are received, these will be factored into your total valuation at live market rates and purchased alongside your gold. Where stones are not of significant value, our team will endeavour to dismantle and isolate them from the gold as carefully as possible prior to the refining process, and to return them to you where practicable. We are gold buyers, not gemstone specialists, and whilst our team will always make every reasonable effort to return stones that have not been included in your valuation, this cannot be guaranteed in every situation — particularly where settings or fixtures make safe removal difficult. By sending items containing gemstones, you acknowledge and accept this limitation.

7. PAYMENT TERMS

7.1 Payment Methods
– Bank transfer (same-day for UK accounts)
– PayPal (fees may apply)
– Cheque (first-class post)

7.2 Payment Timing
– Instant payment: Average 20 minutes (not guaranteed)
– Contact customers: Upon acceptance of valuation
– All payments subject to security and compliance checks

7.3 Payment Conditions
– Payments are final and irreversible once processed
– No amendments after payment issued
– Payment constitutes full settlement of transaction
The finality in this clause applies to genuine transactions only and is subject to Section 5.7, which permits reversal and recovery in respect of items that are counterfeit, misrepresented, not as described, or not lawfully yours to sell.

7.4 Cash Payments
Cash payments are issued by insured Royal Mail Special Delivery under a dedicated secure arrangement, and are available only where the accepted valuation exceeds £300. Where a Gold Selling Pack is received with cash selected as the payment method and the accepted valuation is £300 or below, we will contact you to arrange payment by bank transfer, cheque or PayPal.

8. OWNERSHIP AND RISK

8.1 Title Transfer
Ownership remains with you until:
– We process instant payment, OR
– You accept our valuation, OR
– 14 days pass without payment of rejection fees
Title passes to us on the basis of the warranties you give at clause 5.7.2. Where an item is counterfeit, misrepresented, or not lawfully yours to sell, no good title passes to us, and Section 5.7 governs the reversal of the transaction and the recovery of any payment made.

8.2 Risk Allocation
– You bear all risk until we sign for receipt
– We bear risk after receipt ONLY for our negligence
– Return transit risk transfers when Royal Mail collects

8.3 Liability Limitations
Our maximum liability is limited to the lower of:
– Actual metal value at current market rate
– £5,000 per transaction
– Amount paid to you

8.4 Excluded Losses
We accept no liability for:
– Loss of profit or business
– Sentimental value
– Consequential losses
– Third-party claims

8.5 Insurance Subrogation Waiver
You waive all rights for insurance claims against us. Your insurers cannot pursue subrogation claims against GoldSell.

9. REJECTION AND FEES

9.1 Rejecting Our Valuation
You are under no obligation to accept our valuation. Where your parcel meets our minimum quantity requirements (see Section 5.6), you may decline our valuation for any reason and we will return your items to you free of charge, fully insured, by Royal Mail Special Delivery. No testing, handling or return fee applies.

9.2 When Fees Apply
Fees apply only where a parcel does not meet the minimum quantity requirements set out in Section 5.6 — that is, a gold-only parcel containing less than 5g of gold, a silver-only parcel containing less than 100g of silver, or a mixed parcel that meets neither minimum. In these cases we are unable to provide a valuation or complete a purchase, and the following apply: – £15 admin fee, covering the staff time taken to receive, log, test and process your items – Actual Royal Mail Special Delivery return postage – Any additional insurance costs you paid are not refunded – Fees must be paid within 14 days. This invoice is not a revenue stream for us. As a small, family-run business operating on tight margins — our only margin being made through the purchase of precious metals — it exists purely to protect against the fixed costs of insured logistics, storage, testing and return postage that are incurred on every parcel we receive.

9.3 Returned Items Condition
Items may be permanently altered from testing – Stones may be removed or damaged – We’re not liable for restoration – Returns sent via Royal Mail Special Delivery

9.4 Unable to Contact
If we cannot reach you after valuation: – We’ll make at least 3 contact attempts over 28 days – Attempts via phone, email, and/or text to details you provided – We maintain records of all contact attempts with dates and times – After 28 days with no response, payment automatically processed – Payment sent via your chosen method (bank transfer, PayPal, or cheque) – This constitutes acceptance of our valuation – You cannot dispute the valuation after this point – Evidence of attempts available upon request

10. NON-PRECIOUS ITEMS

10.1 Items Containing No Gold Content
Where a Gold Selling Pack is received and testing confirms no gold content is present, we will contact you promptly with two options: we can raise a returns invoice to cover the cost of an insured Royal Mail Special Delivery return, providing full delivery confirmation and tracking, or we can responsibly recycle the item in-house at no cost to you.

As a gold buyer operating alongside a live and fluctuating gold price, it is essential that all purchased items move through to processing and refining as efficiently as possible. We are therefore unable to store non-gold items indefinitely whilst awaiting a response. Any items for which we have not received a decision within 5 working days of our initial contact will be sent for responsible in-house recycling. We strongly recommend responding promptly upon receipt of our correspondence to ensure your preferred option is actioned in time.

This clause applies to items that are simply non-precious. Items that are counterfeit, misrepresented, or unlawful are dealt with under Section 5.7 and are not subject to the return options in this clause.

10.2 Discretionary Returns of Non-Precious Items and Limitation of Liability

Separately from the standard return process set out in clause 10.1, we may, at our sole discretion, arrange the return of non-precious items. Any such discretionary return is sent using a tracked Royal Mail service, such as Royal Mail Tracked 24 or Royal Mail Tracked 48. Our fully insured Royal Mail Special Delivery service, as described in clause 10.1, is reserved for standard returns and for items of precious-metal value; as non-precious items carry no such value, there is nothing to insure, and a tracked service is used for any return made at our discretion.

Every such return is dispatched with a Royal Mail tracking reference that records its progress from our facility through to delivery. Accordingly:

– Our responsibility for the return is discharged in full once Royal Mail’s tracking confirms the item has been delivered.
– As the service is tracked but uninsured, and as the items hold no precious-metal value, we accept no liability for any loss, delay, damage or claim of non-receipt once the item has entered the Royal Mail network, save as confirmed by the tracking record.
– It is your responsibility to provide a complete and correct delivery address; we are not liable for returns that fail to reach you as a result of an incomplete or inaccurate address.

10.3 Failed Delivery of Returns
– Uncollected returns come back to us
– £10 fee for each redelivery attempt
– Items disposed after 30 days if unclaimed

11. SPECIAL PROCESSING

11.1 Silver Processing
– Silver may take up to 14 days to process
– High-volume parcels subject to additional delays
– Trade parcels processed separately
– We’ll notify you of any extended delays

11.2 Items Sent in Error
If you accidentally send items not intended for sale:
– £20 return fee applies
– Covers postage, insurance, and administration
– Must be claimed within 14 days
– Unclaimed items may be processed

12. LEGAL TERMS

12.1 Indemnification
You indemnify us against all claims, losses, costs and damages arising from:
– Your breach of these terms
– False ownership claims
– Illegal items
– Third-party claims
– Any misrepresentation

12.2 Force Majeure
We’re not liable for delays or failures due to circumstances beyond our control including but not limited to:
– Natural disasters
– War or terrorism
– Pandemic or epidemic
– Government actions
– Market closures
– Strikes or labour disputes

12.3 Intellectual Property
No licence granted to use our trademarks, logos, or intellectual property without written consent.

12.4 Data Protection
– We comply with all data protection laws
– Personal data used only for transaction purposes
– We may contact you regarding your transaction
– Marketing only with explicit consent
– Where we identify a counterfeit, misrepresented, stolen, or suspicious item, we may process and share relevant personal data with competent authorities as set out in clause 5.7.7, in accordance with our legal obligations and legitimate interests in preventing fraud and crime.

12.5 Jurisdiction
– Governed by English law
– Exclusive jurisdiction of English courts
– Disputes resolved in England and Wales

12.6 Severability
If any clause is deemed invalid, remaining terms continue in full force.

12.7 Waiver
No failure to enforce rights constitutes waiver of those rights.

12.8 Entire Agreement
These terms constitute the entire agreement. No verbal variations are valid.

13. PRICE MATCH GUARANTEE

13.1 Conditions
– Written competitor quote required
– Must be dated within 7 days of our valuation
– From recognised UK gold buyer only
– Not available for instant payment customers
– Must be claimed before accepting our valuation

13.2 Exclusions
– Cannot be claimed after payment
– Adjusted for market movements
– Not applicable after acceptance
– Instant payment customers excluded entirely

14. REFERRAL SCHEME

14.1 Referral Bonus Eligibility
From time to time we may operate a referral scheme under which a referral bonus is payable to an existing customer who refers a new customer to us, and to the new customer they refer. Any such bonus is offered at our discretion and is subject to these terms.

A referral bonus becomes payable only where the referred customer completes a sale with us and their Gold Selling Pack meets the minimum quantity requirements set out in Section 5.6. Where those minimum quantity requirements are not met, the referred transaction does not qualify, and no referral bonus is due or payable to either the referring customer or the referred customer.

14.2 General
The value of any referral bonus, and the conditions under which it is offered, are as advertised by us at the relevant time and may be varied or withdrawn at any time. Referral bonuses are payable only once the referred sale has completed and are subject to these terms in full.

15. COMPLAINTS
